Solicitors have issued warnings about using will-writing companies, and the consequences these can pose.
Solicitors are specialists in their field, with legal training. They are able to use experience, and an intricate understanding of the law, to offer added value and advice that will help you through the process of writing a will. However, will writing companies are not privy to the same level of legal training or technical know-how.
Whilst a will-writing service might be suitable in cases of extremely simple wills, trying to write anything other than the most basic will without a solicitor can cause problems further down the line.
There are different regulations for will-writing companies vs solicitors. Some will writers may not be members of regulatory organisations, meaning they may not have indemnity insurance. They also might not be able to store your will. Furthermore, they often can’t offer reliable legal advice.
For these reasons, our solicitors recommend clients instruct legal professionals when it comes to will writing. When writing a will there is no margin for error. A single mistake can end up costing a fortune in the long run, prolonging probate or leading to the will being contested, which can cause your loved ones stress after you are gone.
Our Will Writing Service
Although a large majority of people in the United Kingdom do not have a valid will, the benefits of having such a document cannot be overstated. A valid will carries the assurance that a person’s estate will be divided between beneficiaries of their choice in the manner set out in the will.
Fitz Solicitors write countless wills. After an initial meeting with a client to establish clearly their wishes regarding executors (who will be responsible for administering the estate), beneficiaries (who will benefit under the terms of the will) and guardians (where a beneficiary is a young child), we then produce an initial draft reflecting our understanding of our client’s wishes and request any changes the client may seek after reviewing the first draft document. Once the client is satisfied with the content we will prepare an engrossed version of the will and arrange for the client to sign and to have witnessed. We like to go through the whole process within a week to avoid unnecessary delay and to achieve a successful conclusion.
