How Long Does it Take to Get a Divorce?
Under ideal circumstances, a UK divorce can be processed in a minimum of 26 weeks but the reality is that this can vary a lot depending on the situation.
Initially, if you’re applying on your own then the person you’re divorcing will have fourteen days either to agree to the divorce or to provide genuine legal grounds on which to dispute the divorce. While they are not allowed to dispute simply to delay the divorce, the process of dispute can (and often does) lead to delays.
After your application has gone through, you’ll then need to wait 20 weeks before you can apply for a conditional order or decree nisi. These documents essentially declare that the court sees no reason why your divorce cannot proceed.
Once this document has been granted, you’ll then need to wait another six weeks before you can apply to finalise the divorce.
All in all, it’s a lengthy process and it’s hard to guarantee any timeline from the start. So, it’s important to set your expectations for the long term and plan accordingly.
Do Prenuptial Agreements Always Apply?
Prenuptial agreements are important in divorces but are not as binding as some believe. While courts will often uphold prenuptial agreements, this decision is largely at their discretion and can vary significantly depending on the specific details of the case.
In practice, if you have a prenuptial agreement, you should always inform your divorce lawyer as soon as possible.
