If you’re thinking about relocating with children after divorce, you may be wondering whether you need permission from the court. The answer depends on who has parental responsibility and whether everyone with parental responsibility agrees to the move.

In most cases, you cannot permanently relocate your child abroad without the consent of everyone with parental responsibility or permission from the court. Moving a child overseas without the necessary consent could have serious legal consequences.

When Is Court Permission Required?

If every person with parental responsibility agrees to the proposed relocation, you can usually proceed without involving the court. However, if one parent objects or cannot be contacted, you may need to apply to the Family Court for permission.

Court permission is commonly required where:

If a Child Arrangements Order states that the child “lives with” one parent, that parent may be able to take the child abroad for up to 28 days without further permission, provided the trip is temporary. Permanent relocation is different and will normally require either consent or a court order.

How Does the Court Decide?

When considering an application for international relocation, the court’s primary concern is the welfare of the child. The judge will consider whether the move is in the child’s best interests rather than what is most convenient for either parent.

The court may consider factors including:

  • The reasons for the proposed move.
  • The child’s wishes and feelings, depending on their age and maturity.
  • Educational opportunities in the new country.
  • Employment and financial stability.
  • The child’s relationship with both parents.
  • How contact with the parent remaining in the UK will be maintained.
  • The practical arrangements for travel and communication.

The court will expect the parent seeking to relocate to present a well-prepared plan showing how the move will benefit the child and how their relationship with the other parent will continue.

What Happens If You Move Without Permission?

Taking a child abroad permanently without the required consent or a court order could amount to child abduction under UK law.

The other parent may apply to the court for the child’s return, and in some cases, international agreements such as the Hague Convention may be used to seek the child’s return to the UK.

For this reason, it is important not to make travel or relocation arrangements until the legal position has been clarified.
